I doubt it. DRM never got struck down on music before the labels voluntarily ditched it.
DRM hasn't gotten struck down on eBooks on Kindle or Nook--current law suit is just about price fixing.
DRM hasn't gotten struck down on computer software or games.
DRM hasn't gotten struck down on digital movies.
First sale laws just haven't been applied to digital content. The courts have ruled that selling licenses rather than the content/disc is fine as the consumers are agreeing to a Terms of Service by purchasing and registering the content etc.
I don't like it at all. But that's how it stands in the US and it's unlikely console games will be something that change the courts stance on the issue.
I think we're heading to a fully digital world for these types of content where we eventually just pay for the right to access things, rather than to own copies of them. If the price is right, I personally don't mind. But the price has to be right (i.e. lower than physical goods) since I can't sell it to recoup some costs.

Its not even about ourselves but about console gaming as a whole. The beginning of the end if we do nothing. I will very easily boycott that abomination of a console.
