No. The judge saw it as the NFL overreaching. This decision has to do with the process not if Brady did something wrong.

At the end of the day, cheated or not, it basically confirms the punishment and the effect was ridiculous, just like comparing it to PEDs

Despite not ruling on it the judge has made it pretty clear, through questioning and his final ruling, how he feels about the Wells Report and the alleged cheating.

I think it comes down to arbitration can't be arbitrary, which is essentially what Jay Feely said the other day when the judge asked him about how the league handled his "cheating" with footballs.

Oh completely. I always thought this whole thing was hilarious. I don't expect Goodell to remain the commissioner much longer because anything legal related, he tends to really shit the bed making the NFL the current joke of the month.

Has anyone read anything on what the NFL appeal is going to do in terms of allowing Brady go play? Since the suspension was nullified, he should be good to go even as the appeal goes on right?

Haha im not doubling down. Your post i originally quoted read like you thought there was evidence that proved their innocence. I understand the burden of proof.

Also i cant prove unicorns arent real... because they are.
 
I wonder if ESPN will point out all the inconsistencies in the report and address their refusal to correct false reports.

They have been towing the NFL's company line from day 1 and have let all their minions run free with whatever they want. They will take the popular route and continue to trash the Pats and not fix their own mistakes, or call out the NFL for theirs. That's called, drinking the Koolade and being on the payroll..
 
I love the fact that Goodell's last tweet (which was from over a year ago) is him hanging out with Seahawks fans with "12" jerseys.

Man, I bet he's going to hate the #12 for the rest of his life.

The NFL has chosen to allow him to play while the appeal goes forward. If the reverse had happened, Brady would have sought an injunction that would have allowed him to play.

I am slowly reading through the decision. I found it amusing that Judge Berman quoted the word independent when he was referring to the Well Report.

On May 6, 2015, the findings of the Pash/Wells "independent" Investigation were made public.

I think they might be able to, but I doubt they will. Just let it go and move on at this point. I hate that the NFL took away a first round pick, but let's just put this joke behind us and play football.

They should. Those draft picks lost are a big fucking deal. The money...who cares. But those picks? Can't let that slide, IMO.

Well at least Goodell hasn't lost the respect of the players...

Are the Pats protected by a similar collective bargaining agreement as a player is? I doubt it. I don't think they would have the same grounds to appeal.

I believe they got fined for obstructing the investigation by not making the two guys available for a second interview. If they didn't, it would be hard for them to win.
 
The NFL's credibility when it comes to securing footballs went to hell when it was discovered a league employee was stealing balls. From that AFC title game. That were supposed to be sold for charitable donations. What a joke.
 
Pats case wouldn't be because the owner doesn't have the same rights as a player. Being an owner basically says you can do what you want to me, I'll take it.

It will not and was never going to happen.

Thanks for the level headed response. I agree the Wells report is horrendously flawed. The Pats'response to it was pretty laughable too though. Not saying Brady is guilty to the extent many are, but the whole thing has seemed very fishy from the start... from both the NFL and the Pats.
 
Finally. The league had an open and shut case to punish the Colts for absconding with the Patriots ball and testing it in violation of league rules.

Instead they decided to punish the Patriots. And they doubled down on that punishment even after it became apparent that there was no evidence the Patriots did anything, and that the scientific evidence suggested the balls were not deflated. Rather than have evidence, they used false reports to win public opinion.

The league's arguments to the judge were so bad it seemed like they weren't even trying. Just "the CBA lets us do anything we want, including interpreting the CBA any way we want", which is instantly ridiculous.

If there is some way to get the draft picks back, the Patriots should go for it. The sad thing is, this can't put much pressure (if any) on the league to improve, because at no point was there any threat to their ratings. I could almost see the league using this lawsuit as a fishing expedition to increase their power; make terrible arguments, and if they win, game over for the players. Hopefully they prove me wrong and oust Goodell.

There was a report put together by an outside group, AEI, that pretty much destroyed the science and methods in the Wells Report. No need to rely on the Pat's response.

But how do you turn a blind eye to the patriots response?

For example, the pats explaining mcnallys referring to himself as the deflator by saying he was trying to lose weight...

Unclear. With no recordings of pressure pre-game and with questions about which gauge was used the pressure change is in question. It mostly depends on which set of assumptions you go with. Basically it can look normal or abnormal depending which gauge you believe was used etc.
