Upcoming Indiana Jones game is a Xbox console Exclusive

I'd be very surprised if it's not exclusive to Xbox and PC. Interesting to see if it can hit the heights of the Uncharted series (although that music should add a lot).

Did we get confirmation wolverine was not multiplatform? I only saw it say in development for ps5, not exclusively for ps5. No way Disney is going to let Sony reduce the potential revenue right?

That's how we play this game right?

Somewhat different situation, as the Indy deal would have been done prior to the Bethesda acquisition. No such shenanigans at work with the Wolverine deal.

It’s perfectly reasonable to speculate that the Indy contract could be cross platform in that case, as it was done when Bethesda was independent.

All depends on what Disney stipulated about the game’s release.

Actually they said exclusively for PS5 :messenger_grimmacing_:messenger_grimmacing_:messenger_grimmacing_:messenger_grimmacing_

It's not what MS says, it's what's in the contract. There may or may not be a clause where MS can pay a fee to get out of the contract. I'll copy and paste what I said in another thread with a few changes:

Not to make this overly confusing but the licensor of a worldwide known HUGE IP like Indiana Jones generally licenses out the product to the licensee for a minimum guarantee + a royalty (the two are not cumulative). Royalties in games can be 5-30% of the revenue and it can be a sliding scale or differ depending if it's sold directly to the customer or through a 3rd party, for example. Reports must be provided monthly or so so for example:

Licensor grants licensee the rights to produce a game based on a license. Minimum guarantee is 80MM. This means the licensee must pay the licensor that amount no matter what (usually in installments, i.e. 40MM upon signing the agreement, 20MM on X date, 20MM on Y date). Can be more installments and can vary (i.e. 2nd payment upon milestone X, 3rd payment upon milestone Y, etc), you get the point. Royalty rate for this example is 20% of the revenue.

Scenario A: Licensee botches and provides a shitty product that bombs and sells horribly. Let's say total revenue is 50MM for the product. The licensee still has to pay the licensor the 80MM minimum guarantee. This is what happened to the Avengers game. SE lost a shitload of money. Marvel still got paid.

Scenario A: Licensee provides a well received product and it sells great. Let's say total revenue is 700MM for the product. Licensee has already paid the 80MM minimum guarantee and has paid the licensor the royalty rate in a monthly or quarterly schedule. Licensor has made 140MM on this license agreement. This is what happened with Spider-Man and Miles Morales games.

Exactly. And in this case the license would have been agreed prior to Microsoft owning Zenimax. It would have been really unlikely for Zenimax/Bethesda/Machinegames to have negotiated an Xbox exclusive license prior to the acquisition.

It is, of course, possible that Microsoft have offered to renegotiate the license post-acquisition but Disney would be under no obligation to agree that.

The situation remains unclear.

The publisher is stumping up the cash to make a game with their IP. Whether it's exclusive or multiplat its all gravy for Disney. They don't have to do much and get paid

Its more unlikely they would take the deal off the table because its going to different platforms

Ask me about my fanboy energy!
Why is it so unlikely to assume that Bethesda will make a exclusive deal months before their acquisition with Microsoft? Like why would Todd Howard make a deal like that months before joining Xbox. Xbox console exclusivity could have already been part of the deal.
I also see a lot of XGS employees retweeting this but not SIE employees

I agree with the principle, Bethesda games will be Xbox exclusives

But I have doubts in relation to Indy, it’s not obvious here. This is a licensed ip and the deal was signed before the acquisition, whether it’s exclusive or not will need to have been endorsed by Disney.
Yeah there have rumours stating the opposite due to Disney's insistence.

Missing out on the dominant platform isn't going to be an attractive proposition.

A rep at Sony stated that they didn't know if Indiana Jones was coming to PS5. That was a big tell. Sony would have known if an IP that big was coming to their platform. It's Xbox/PC exclusive.

The problem for MS here is that the contracts were made before acquisition. Phil Spencer was clear about contractual obligations.

Bethesda doesn't own Indiana Jones, and no doubt they were making a multiplatform game before being acquired, so MS would have had to renegotiate the contract (i.e. pay Disney even more, if they even want to accept it that is).

It's up to Disney. Could go either way. MS would naturally push for exclusivity (that was the point of buying Zenimax after all - taking third party games away from consumers).

Maybe Disney conceded and proposed more Marvel IP to Sony as compensation, who knows.

I still don’t think it will be exclusive. Seems like this was all agreed before ms acquisition. Probably will be multi platform with gamepass day release.
That's what Klobrille said earlier in the year. Utimately though it'll be on PC at least.

It's not coming any time soon though so might be a while before we see it.

I’m sure there has to be some give, it’s how business works. Sony are getting spider man and now wolverine as exclusives. Microsoft will be absolutely knocking on Disneys door with the WTF about us convo

The thing that always makes me doubtful about this stuff is that IF a game is signed as an exclusive, why aren't they upfront about it? Why be bashful about an arrangement they've presumably already paid for?

It makes them look indecisive and/or uncommitted to be so vague about it.

Euh, isn't it what everyone assumes, given that MS acquired Zenimax? 🤔
And, not to pee on the party cake...but is Indiana Jones that big of an IP today?

Yup this one is very clearly a MLB scenario. On the other hand so is Wolverine and afaik it’s a PS5 exclusive.

No one is saying that Microsoft can’t negotiate an exclusive licensing deal with a big ip, like Sony have done with Wolverine and others. Sony had an exclusivity agreement with MLB for years but when that expired the licensor decided that they wanted the game to be multi-platform.

THE point here is that the license for this was agreed prior to Microsoft ownership of the publisher and developer. MS don’t get to tear up the agreement, they will honour it just as they have honoured other Zenimax pre-existing commitments.

They can, of course, try and renegotiate the agreement and buy full exclusivity, but Disney have no obligation to accept any such offer.

The give or take would have been more like Sony asking Disney about what happened to that Indiana Jones game that was supposed to be coming out everywhere, and Disney then let them have Wolverine too.

It's up to MS to negotiate any other Marvel licenses with Disney.

could be that and i don't care about both personally but getting indiana jones when competition get wolverine is a bad deal if the objective is to seduce mass audience in 2020+.
Opinion of course

To be fair, not everyone is following this stuff closely, I had no idea it was being developed by an MS acquired studio.
Wah.

I would assume everyone on an enthusiast gaming forum would know that this is all Bethesda 'property' and by extension now Microsoft's. Obviously these titles are never going to see the light of day on Sony's platforms.

Every week it's the same thread of people exclaiming "Game X will be exclusive to MS consoles" as if we have collectively forgotten how console exclusive releases work ever since MS bought a few studios. whiteguyblinking.gif

Hmm, I’m not sure we did. Anyway, Sony is not in control there, and neither is Microsoft with Indy. Everything depends on the contract, which we’ll never see.

Be really surprised if this was part of a quid pro quo for any Xbox deal.

Sony and Disney already have a great deal of common interest as a result of Sony's ownership of Spider-Man movie and merchandising rights hence the various deals to have Spider-Man in the MCU, to have Marvel Studios produce Homecoming, to bring the Sony movies to Disney plus, etc. They have more than enough bargaining chips in that conversation.

The Spider-Man relationship has indeed been there for a long time and getting Spidey in the MCU made it stronger, yeah. But still, it's only regarding that IP.
Not X-Men.

I'm intrigued as to what is going on there.

Having said that, Indy is likely an exclusive. Could also be multiplatform, depends on what was signed, when, and the amount of intervention by MS.

Who knows.

Well, that would be stating the obvious for, say, Starfield or TES VI.

However, one could equally assume that everyone here would know that Indiana Jones is not Bethesda's property, and by extension not Microsoft's either. 🤷‍♂️

Indiana Jones ip is owned by Lucasfilm, Lucasfilm are owned by Disney.

Indiana Jones game was contracted prior to Microsoft owning Bethesda. The game will be produced for the platforms specified in the licensing agreement.

The only way this is exclusive is if Disney agreed to a proposed change to the agreement.

We need a better source than a Twitter “insider“.

I don't even have a PS5, so I'm no Sony fanboy.

I'm not following Bethesda games closely, to be honest I'm not even sure if I've ever even played any of their games, so is it really that shocking that there might be some people unaware of who the developer of a specific game is?

It'll be Xbox /PC exclusive. I'm just hoping these yokles can handle it when they reveal it. Microsoft already allowed two games to go to Sony's machine. Not a chance in hell they allow a game years off to do the same.

They didn’t allow it they were contractually obliged to deliver them.

Same rules will apply to Indiana Jones. So, what does the contract say? I don’t know, you don’t know and neither does the fake insider whose tweet started this thread.

I’m stunned by how many people seem to be either forgetting this, or trying to deny it‘s a factor.

I know the great console wars need a constant supply of ammunition, but this might not be the right one to be sticking in the chamber.

Yup, I can imagine it going wither way. Disney is deffo loving the Sony relationship. Spider man was a huge success so I could totally see dianey saying to Microsoft that there is no way that Indy can be exclusive.

the same marvel is losing not releasing their games on PC/Xbox/switch

Difference being, of course, that Sony actually own the rights to a number of Marvel characters which gives them a unique negotiating position for those properties.

And no one is saying the MS can’t pitch an exclusive deal to a licensor like Disney (these things are at the discretion of the licensor and will consider factors other than just cash) but the most important factors here is that the Indy deal was done pre-acquisition.

It depends on the terms the licence was given from Disney to Bethesda and it was **before** the acquisition.
Why Disney should have given the licence to a then multiplatform publisher to make an exclusive?
We'll see, things can change, contracts can ben be reworked but no it's not obvious that this game is exclusive.

Marvel owns the video game rights to EVERY Marvel character. Sony has the film rights to the Spider-Man characters but that doesn't mean they own the game rights to them, otherwise the Spider-Man characters couldn't appear in Ultimate Alliance 3, the LEGO games, or the endless mobile games Marvel churns out.

I thought it was very possible this was multi due to when the deal was probably inked. With this locked down I do think we see anything else go multi

We don’t know either way. Spider-Man’s appearance in other games may be part of the deal Marvel has with Sony. If I had to guess, Marvel and Sony have created an arrangement that bridges movies and video games when it comes to Spider-Man. This sounds like a multi-layered agreement that could very possibly allow for Spider-man's appearance in other games, not named Spider-Man.

Look at it this way, from 2000 to 2014 there were 16 "Spider-Man" games. In February 2015, Sony and Disney made a deal to bring Spider-Man into the MCU. After that, the only games released named "Spider-Man" have been from Sony and Insomniac. That is pure speculation on my part, but that timing is pretty dead on.
