Doesn't matter how many times you say it...Microsoft still don't own a time machine. What exactly is the pragmatic proposal to improve their position that doesn't involve correcting the past?

Sony lost the ps2 momentum, because of ps3 horrible system. Which allowed xbox to catch up to them.
MS should have been careful. They had 2 gen without full 1st party support, and didnt invest heavily on the platform. Its why xbox one suffered alot.

I think you'll find most PlayStation owners won't be swayed and their position is far from at risk.
Those users are minor. The real users are casuals, who have no loyalty for your brand aside of those games. You take those games away, and they would happily leave your service.
Not to mention, those users buy your 1st party games. Its why Sony 1st party games sells alot.

And acquisitions seem like a suitable avenue to compensate for dwarfed market share and increase competition.
MS already has 25 studios. Activision is overkill. Do you know how much games can those studios make?

This is all very rich, now who's saying "wait for next year".

It suits the Sony loyalist position that Microsoft should 'shut up shop' and be content with what they have, and yet discussing game releases and quality they'll return serve with the quips mocking "wait for next year."

Sony did that, because the invested in their system during ps3.

again, not sure how this is a 'gatcha' - for example the CMA's official position is that they are concerned games will be taken off other platforms. that's not bias, it's their position as part of this review.

Make a claim, can't back it up, act like a clown. At least the CMA published a 70 page document backing up their position, you can't even copy and paste something (because it doesn't exist).

I'm a forum poster, the CMA is a regulatory body, I think the burden proof is heavier on them. I'm not sure how I'm acting like a clown or making big claims. When the report released I watched several clips reporting on it (a few from the major networks) and read quite a few articles. I didn't keep a log of exactly who said what and where. You have your opinion, I have mine. It is what it is. Not sure what set you off here.

I'm really not following any points you're trying to make here.

Sony invested in their system - yes. Microsoft is doing the same years later - yes. Problem?

Contrary to many beliefs, they are not beholden to this idyllic version of competition people have in mind. So long as 'all's fair in love and war' and business isn't fair, let's be fair about the unfairness. Sony is free to use their brand power and position to broker deals, and Microsoft is free to use their cash to do something about it.

That is how competition works. Just like x360 vs ps3. Not taking entire publishers, which has huge followers, and locking them to your system.

Isnt that what the publishers wants? A guarentee userbase for their games.

Xbox lack of presence in japan allowed certain games to skip the console completly. You cant expect them to put games on your system, or marketing rights with that lower userbase.

MS needs huge investment in their system. From gamepass, to 1st party studios pumbing out games, to 3rd party deals like Ronin ps5 with team ninja. That is how you build a platform, and userbase.

Though a string of individual studio purchases would be easier to close, other than that I don't see much difference. The end result is the same.

I don't have a problem with exclusivity deals or marketing agreements. If you want to play something that's not on the platform you have, you'll have to purchase whatever is needed to play it. Same with first-party studios. A game being exclusive is never going to limit consumers, if a gamer refuses to follow the game to wherever it's at, that's a self imposed limitation.

Hard to say that one is okay and the other isn't. The gaming industry is going to see further consolidation, regardless of if you like it or not. It's weird to me to take a position where MS shouldn't be allowed to partake in that as the smallest console player, with that right reserved for the dominant party instead.

When Sony entered into gaming their market cap was considerably higher than the competition and they made good use of that. I don't think there are any rules that enforce a spending cap at whatever level the smallest competitor can afford.

Sony didnt own any system at that time, compared to other competitors who had their own system. MS could have done the same back then. Regulators wont have any issues with that.

I dont see them actually investing very heavily in exclusive 3rd party game. The only game they have so far is contraband.

Activision was for sale and MS had the means and opportunity to complete the deal, so they did.
Nobody is blaming them for that. Its why this deal would pass. The problem is COD. A major historic game, which can distrupt the market. And the price of that purchase.
All MS needs to do, is talk to regulators and sign that concession with COD, in terms which they can agree to.

The talk with the media is making this a shitshow. MS is using the public outrage to get out of these concession. Sadly its working. We just saw one today.

Regulators arent taking any side. And their opponent is a company, which spent a total of $75b on 2 big publishers. They need to do their job. But the rivalry between MS and Sony is getting in the way of their work. Too much emotion, and less time for critical thinking.

If xbox one was like x360, ps4 wouldnt have been that succesful. And MS wouldnt have lost COD to Sony.

Both companies had plunders, and they paid the price.
 
I know this is an approval thread so all focus has been around the actual dirty work around the deal going through or not.

That being said, I'd like to know peoples genuine thoughts on the outcome of this deal going through.

Personally, I would like to see more content on Gsmepass as I feel it offers me better value. Also, I feel like MS would make an effort to get more out of under-utilised Blizzard properties as part of their need for more content to fuel their subscription strategy. They're my 'selfish' reasons for seeing the deal go through.

Further, I think that lighting a fire under Sony will give them the incentive to be more like PS4 era Sony. Hungry for customers, willing to sacrifice profit for value. I love that Sony!

When I compare that to the potential downsides listed by the CMA

- If MS lie and make COD exclusive.
Yea, sucks for people that will only buy a Sony console and want to play COD. But will it make everyone not buy a PS6 and result in the demise of competition in the industry? Maybe, but I feel like Sony has a bit more pull than just COD to keep them as a platform of choice.

- Streaming is the future and this deal sees them gain an unassailable lead with Gsmepass and they own the industry.
Well, given the fraction of the industry that streaming takes up now, and the issues with internet infrastructure that effect this future among other things it's a bit of a stretch imho

- this starts an all out exclusivity war!
Pretty sure that's what early gen gaming was like and everyone loved that era. Or at least look back on it fondly.

When I add it up, it just seems like so little at risk of letting this deal go through from sn industry/ consumer perspective.

As a final comment, I own a PS4 a Series X, PC and plan on getting a PS5 slim when it comes out, so I'm not a 'rabid fanboy' as some may think. I'm interested what others genuinely think?
 
The deal would pass. All that is left is COD on other systems.
If MS comes to terms with regulators, it will pass.

Sony did that, because the invested in their system during ps3.
That is how they got their current users. MS should have done their model.

Hell, they are doing gamepass model, which is actually selling their system very well. Especially when this year, they had almost nothing from their 1st party studios.

That is what they are doing now. It's why they can't go a head and blame PS.
MS has tons of opportunities to beat them. Decided not to invest.
And now PS is enjoying those moment.

PS isn't the villain here. Exclusives exist. MS would have done the same thing, if Xbox one wasn't a disaster at launch.

I mean, they managed to get FF on xbox during x360. That is what MS was capable of.

CMA concerns is only from COD. It can distupt the market, but not cause a monopoly. Their biggest fear, is MS wallet.

68b plus 7.5b on 2 big publishers isn't an easy thing to do. MS just did that. Without their intervention, MS would spend more money buying big publishers, which could lead to a monopoly.

Wouldn't the concern then be the regulation of subsequent acquisitions rather than preemptive actions to prevent what might happen in the future?

They are looking at how they are spending the money now because the pattern already started. While they ride contractor waves for their previously started studios (see 343i, see The Coalition, etc…), they switched from buying and hopefully nurturing small studios (or setting up new ones) to buying big Multiplatform publishers that have titles that are key to the competition too.
It is about growth and support for their subscription service but also removing games from the competition that the competition depended on (TES Skyrim was immensely popular as a Multiplatform title and future TES titles being exclusive, DOOM 2016 and Eternal revived DOOM as a Multiplatform franchise and next titles smell like exclusive too, same for other big titles which were already WIP on multiple platforms like Starfield where MS acquisition resulted in the WIP PS4/PS5 version to be killed and Bethesda kind of apologising).

You're essentially arguing that if MS potentially revives old titles and creates new strength through developing new games through their existing acquisitions that they shouldn't be able to aquire anyone else?

We're currently seeing Sony move to 'Monetise' with their strategy right now, but we should prevent MS from acquiring an increase in market share because they might do the same in the future?

? The regulation needs to be based on current happenings and actual outcomes. Otherwise we just get into pre-cog shit about 'what might MS try next!' …

Otherwise you could just make a slippery slope and shut down any acquisition based on what future acquisitions they might make regardless of knowing what will occur if the current one eventuates.

Acquisition cost 68b. That is the red flag.
If it was 30b to 40b, there won't be that much issue.

Even MS admitted that.

Regulators job is to protect the market from these type of purchase. If there is no protection right now, future market would be in trouble.

The franchises were already revived/still alive and popular on multiple devices.
If MS were creating completely new titles or reviving dead franchises it is one thing, but the worry is about taking existing Multiplatform franchises and removing them from other platforms which you are dancing around :). We are not talking about new titles possible only due to the cash infusion, we are talking about existing Multiplatform franchises being removed from one platform they are competing against.

Regulators should look about market distortion effects, what each merger results in and the market affects it has. What you are arguing is closer to a boiling the frog effect where monopoly scenarios are a happy coincidence of a chain of events that is not isolated to single moments. Distort the market enough cutting the oxygen supply of your competition and more third parties fall in line with exclusive deals that cost you less and less to make.
The industry is not gaining new titles with these purchases, it is not growing, this purchase like Bethesda it is more to remove titles from the competition than anything else.

MS would own 2 big publishers, Xbox publisher. Any future acquisiotion would put them closely to a monopoly territory.

Any practise which can create a monopoly is on the table.
The reason why Sony isnt considered on that territoy, is because Xbox exist. Now add a company who is ready with unlimited money, and you can predict what they might do with that money.

The purchase of bethesda already caused a problem. Now with activision sale, most publishers are now looking to sell themselves. MS might snag some of them.

Not right away, but it creates a credible risk for the market to shift that way in a way regulators cannot do anything about after the deal goes through. The ir concern is that the intent of the deal, like what they have shown with the Bethesda deal, is felt as removing titles from the competition more than adding new value.
The day MS feels like they have regulators eyes off them and enough mindshare with theirs publishers that gets them timed or full exclusivity deals on a per title basis sure, they would see when and how to walk back Multiplatform deals like they have done with sequels to Skyrim (new TES titles) and other Multiplatform series (like StarField).

Yes, I do bot think they do much. MS will not try to acquire EA next sure, not soon anyways, but regulators cannot and have not stopped smaller acquisitions or especially (timed) exclusivity deals on a per game basis and you do know that.

This is still all pre-cog shit. On topof that you suggest MS should be preemptively restricted because the regulators may 'take their eyes off them'. Bizarre position
