If I'm a shareholder I would agree to an extension to keep up the stock price and still leave open a chance at the higher stock buyout price.
Activision's stock hasn't really hit rock bottom yet.
If the EC rules against them it'll dip again, if they lose the appeal with the CMA, it'll crater.
An extension makes sense for Activision. It's Microsoft who might want to bow out, but they're on the hook for 3 billion, it's worth it to them to extend it for as long as os possible.

Oh yes but to be fair she's not a Microsoft employee so they are not responsible for her behavior. Still crazy though and definitely not something I expect from someone in her position. Then again I didn't expect to see Phil say those things in that interview.

As a shareholder, I'd vote no. After July 18, the deal expires, and ABK receives $3 billion from Microsoft. That's 2 years' worth of ABK Net Profit!
The stock price shoots up again. And as a shareholder, I win.
But if they vote yes, they will only delay the $3 billion payment. And until they receive the cash injection, the stock will continue plummeting.Even if/when the deal fails they still get the 3 billion.
3 billion won't be enough to keep the stock up, it's going to plummet. I would do anything to stave that off or potentially prevent it.
The only problem is Activision needs to start working on 2025+ deals. I expect Bobby is going to want to talk to Jim as soon as possible.
That's going to be a tall order for Activision. If I'm Sony, I'm not doing any deals unless they sell the rights to Crash and Spyro, and sell Toys for Bob. The reality is Sony doesn't really need a new Activision deal.

Also, until the deal is officially and finally in the can, Activision can't talk to Sony for a future marketing deal. The usual time to renew (as per Bobby) was already months ago. Every passing week is going to make things more difficult for ABK to get a new deal.
The best thing for ABK would be to resume their normal operations as soon as possible. For that to happen, the deal will have to be completely dead and behind them.

They know there is going to be an uphill battle with getting a deal done with Sony. They might have to just deal with Microsoft instead, though it will be a less lucrative deal.
The delta on how much they could make on this deal is still worth keeping hope alive for a few more months.
Nah this is who she is, she was equally disliked when she was employed by Substack.I mean think about it this way, she was primed to get 10s if not 100s of thousands of dollars in stock options and spot bonuses if this deal went through, and the alternative is she is probably the most likely individual to get canned when this is all over.
The dichotomy of this would probably drive a lot of people to extremes.
Imagine if I said, hey, if this deal goes through, you're going to get your house paid off vs if this deal doesn't go through you're out of a job?
Not defending her actions, she's played this poorly. Sony is Activision's largest customer/partner, you want to tread lightly in these situations.
