Ana de Armas fans sue Universal for $5 million for cutting her out of 'Yesterday'

According to the complaint, which was obtained by Fox News Digital, Conor Woulfe, 38, of Maryland, and Peter Michael Rosza, 44, of San Diego County, Calif. filed a class action complaint in the United States District Court of Central California against Universal. After they spent $3.99 each to rent the movie on Amazon Prime, they were upset to discover that the actress’ part had been cut out of the movie.

The duo is seeking $5 million on behalf of themselves and all other affected consumers who may have spent money on the movie in the hopes of seeing the actress only to be disappointed. They accuse Universal of engaging in deceptive marketing.

"Because consumers were promised a movie with Ana De Armas by the trailer for ‘Yesterday,’ but did not receive a movie with any appearance of Ana de Armas at all, such consumers were not provided with any value for their rental or purchase," the lawsuit states.

As Variety notes, the suit bears some resemblance to a case involving the movie "Drive" that was filed in Michigan in 2011. In that case, the plaintiff alleged that the trailer made the movie seem like an action movie. Instead, the film was a thought-provoking, inter-personal drama starring Ryan Gosling.

That case was eventually ruled in favor of the defendants after they argued the trailer was protected under the First Amendment.
If this part of the article is close enough to this Ana de Armas issue, looks like the fans will lose.

Although I totally support the fans. Companies have way too much leniency in business law when it comes to misleading fans with puffery or in the above part about first amendment rights.

This case shuld be more scrutinized as it doesn't even include the actress. At least with Drive, it sounds like the misleading trailer was true in content, just cherry picked. Ana de Armas isnt even in it at all.

That's like a concert promoting a band will be there by showing them in promos, but they arent part of it. And the concert promoter never tells the ticket purchasers they arent in the show.

The hell you say, she earned every SECOND of screen time in NTTD. Paloma is the only "female 007" I would accept at this point and I hope to god that they use her as the Felix stand in from here on out.

The chemistry between her and Cavill will be NUCULAR! :)

To be fair, she is in the trailer and is shown as being a rival love interest. Universal fucked up there.

I Like Anna too, but man this is pretty lame. She is fantastic in the new Bond film, probably the best part of the movie. Also good in Blade Runner 2049.

the funny thing is that they paid $3.50 for the movie, but are suing for $5 million.
Smart move to force a settlement (though I think this is being approached more as a class action lawsuit that would reimburse each person their ticket price). Universal has a POTENTIAL loss of 5 mill, so they cut these dopes a $5000 check to STFU. Win win!

Showibg an actor in the trailer that is t even in the film is pretty egregious. A bit different than using alternate takes or action scenes that are later edited differently. Rogue One is a good example, the trailer is full of scenes that werent in the end cut, but it didn't advertise Harrison Ford and then not deliver.

If they win, who can I sue over the Fant4stic movie from 2015 where the release trailer 12 hours before the movie came out had the scene where Thing jumped from the helicopter but then the scene wasn’t in the movie?

It seems like a stupid and superficial suit (and it is), but they kind of have a point. I don't think it was intentional deception though, and i don't want the final cuts of movies being influenced by stuff like this.
