Japan has no protection for parodies, so you usually need to either make it far enough from the original or do parodies with legal authorization. Most of Gintama's obvious parodies are based on Sunrise or Shueisha proprieties. Some other ones are based on proprieties that are heavily merchandised by Bandai (which owns Sunrise), so they might have gotten some behind the scenes authorization for it.
