Automatic. Fire up a game and it'll start downloading the patch. If it doesn't download then it's already patched.

Press options and check "Update History" or "Check for Update" for more info as well.

Yes this is the case. My friend at EB who manages a few stores was notified that Nintendo will continually ship them out batch by batch. Small batches at that but at least this isn't Amiibos all over again.
