Asking some of the people in that thread to understand these definitions are being set for the judge's benefit (and to ensure that both the lawyers and the witnesses are on the same page regarding what's defined as being discussed), is like asking them to use their own brain.

It's the same old intellectual dishonesty from the same people, as always. It always matters when it can be used for their hype and marketing but as soon as it's exposed, it "no longer matters".

Had someone try pulling the same line of "logic" yesterday regarding Redfall. Now claiming that "no one cares and it was never expected to be good", which was a straight up lie. Microsoft zealots certainly cared and hyped the game up all the way to a week before release. But now that it's one of the biggest train wrecks in the industry, suddenly, the narrative does a 180.
 
Metrics of success are on Console Gen 9 share. As established yesterday they didn't include the Switch in this category.
Also presented that info to board to brag about their console share (when PS5 was short on supply), around June 2022. So very much recent.

Now they can't get back out of it 😄

The FTC really is doing a great job. I wish the CMA had a similar process.
 
I wouldn't give a fuck either however I could at least understand why the feeling wouldn't translate the same if it were Sony doing it due to them being viewed as kicking the shit out of Xbox's ass.

It is curious that many would push back against the idea that a multiplatform producer (previously) was planning for their game to be multiplatform. Some people just can't be helped.

They hyped it up during the switch reveal, and to my knowledge, only "123 switch" uses it. It's disappointing as I was intrigued with the tech, and this fact caused me to initially dismiss the haptic feedback in the DualSense. I have since had experience with the DualSense and it did indeed deliver on their claims.

Unfortunately that fact is all too true across multiple levels of government. It's part of the reason why I support term and age limits for the Supreme Court. Having 70 and 80 year old people ruling on cases they have little grasp of that can shape jurisprudence on the issue for decades seems… wrong. In such highly technical cases, it's not the Justices giving their opinions, it's their staffers working through them.
 
It's funny how some of you think FTC doesn't know technology simply based on the question they are asking. They are asking the questions this certain way as the answers are for the Judge, not themselves. hahaha
