Yes. She's clearly not convinced that cloud gaming is a market on its own.
it is tho, its completely different from console gaming and sub services because its shared differently.

I can download and buy a movie and play it anywhere as well as stream it from a sub service. I can't download and play a game on every platform like i can stream from the cloud (cloud can be played on everything).

I understand the Judge's questions here, but you can't compare the Switch to Xbox Series S, just because they cost the same price.
Similar market imo - people on a budget, kids, europoors, other 3rd world countries will be debating between these boxes. And may splurge for the PS5 anyways

The minute someone like Ubisoft shows turmoil, here they'll come, same for Sony.

I hope everyone looks forward to a guaranteed acquisition war, because that's exactly how Sony will respond if it goes through.

The question mark indicated a question. But understood. It seemed you responded to someone else saying they were going to lose because the judge doesn't get the market, so seems I wrongly assumed you were agreeing with them...

I think the FTC has a better case than they are presenting. I still don't think they would be granted an injunction in the U.S. even if they did put their best foot forward though, so maybe they're just phoning it in.

Putting the word "idiot" in quotes threw me. No worries though. I think this judge gets the market about as well as most judges would. She seems on point to me. The FTC and their witnesses just sound silly. You can tell which lawyers are getting paid by trillion dollar corporations and which lawyers are on the tax payer's dime.

Sorry, I did that because I was distilling the sentiment down from 'doesn't get the market' down into incapable (which is the same thing at this level) - was meant to represent airquotes, but can see how that might have been confusing as to mean a direct quote.

Different markets can share the same content. Type of content isn't necessarily what makes them unique, not in and of itself. Delivery of the content and the market's influence on certain choices of content in that market also help define markets as being unique to one another.

So this timed exclusive is different from other timed exclusives because an unofficial listing, NOT from Sony or Square, that lists Bloodborne as a 3rd party exclusive says so?

It takes TWO to tango, It's not like Microsoft holds a gun to someone's head. It's up to the other publisher/company if they want to be purchased or not.

Some indicative and data provided by Microsoft with proven wrong data with Bloodborne. You have less of a case than ftc.

This will start an acquisition war, plain and simple. If it clears, I would wager that Sony will respond by taking Square within a years time or so. You can bookmark this post.

What precedence?
FF7R and FF7R Intergrade exclusivity ended, if Square doesn't release the game for Xbox it's because they don't think it is viable to port, debug and optimize 2 versions of the game for the pitiful amount of sales it would have there.
Publishers want to make money, not get nervous in hopes of breaking even.

sorry but I am not aware that we have the details of exclusivity agreement for FF7R. Can you share it with me?

I want to add that I would consider it similar to FF7R if even the PC port was kept undisclosed from the beginning. And don't we have a thread how the FXVI exclusivity came to be in the first place?

A good analogy for the judge to understand might be to describe consoles like the horse and cart at the introduction of the motor vehicle.

Both vehicles in essence do the same job with vastly different hardware, and initially compete, but they are different markets. No one looking to buy even an old car is considering a horse and cart as a substitute after the nascent car market moved to being established and cars could cruise at 50mph.

It's being cheered by a bunch of people who don't even play Call of Duty nor any of ABK's titles, who are under the impression that MS will buy whoever they want failing to realize the shoe might be on the other foot if ABK goes through, and we will be talking about franchises the hardcore actually care about.

Nothing would be more karma than Sony somehow buying take 2 and making GTA exclusive... not that I think it would happen but can you imagine. Even Capcom which seems to be on a huge uprise

given how much some on here like to complain about Street Fighter V, imagine if Sony bought Capcom

have a feeling a lot of those cheering Xbox's acquisition spree would suddenly be complaining

of course if it weren't for double standards some would have no standards
 
I think a judge that hears Federal Trade cases likely knows more about markets than you, bud.
She even admitted before the case that she is not too privy about the game industry. This is a "learn as you go" establishing case law.

Maybe she should check her condescending tone for someone who seems to lack context and nuance about all the moving parts and wants to essentially say, "a car is a car."

No, he's trying to mock me for saying the judge sounds uneducated for not knowing what factors go into defining a unique market.

And, I did, because they don't seem to have a good grasp on it. They are thinking along the lines of Netflix and distribution of content, but content distribution is one of the factors that actually define unique markets in the first place! Arcades & home consoles for example were unique markets still in the same industry, in large part due to how they delivered content and how the content was accessed.

The judge seems to think that they need to have completely different types of content altogether or maybe even be of different mediums in order to be defined as unique markets, which is incorrect. But it's up to the FTC and their witnesses to convince her of a better viewpoint.

Apparently if Jim sent a list of Capcom games to be on Xbox and include Street Fighter II, its great. 🙄
