Naw I don't think he's personally a big fan of Microsoft, though maybe he would prefer working under them than the current Activision? He has said things on his twitter multiple times about why would you buy a Series X when you can buy a decent PC instead etc. I think he even helped design the Series X?

Not terribly surprised, the judge did all she can to help them, even reducing the length of the TRO.
Now let's see if the FTC tries to appeal and what's going to happen with the CMA.

I digress, here we are and the meltdown has commensed. Corleys decision was so thorough that anyone who thinks there will be an appeal is delusional. Not only did she point out that the FTC failed on every point, she told them they almost certainly wouldn't win a full hearing.

Guess I wasn't "gaslighting" after all, huh mods? But go ahead, rack up more points for this post too. 🤷‍♂️

I think you are melting down more than anyone else right now. So . . . .
 
Nah, it's a done deal. The UK will find a way to as Brad just put it "creatively" come to a solution. This has all just been a side show while various entities take their pound of flesh. Move on and accept the new normal.

Unfortunately, that could certainly happen. The Tories are as corrupt as ever and would like to use the deal as bragging points to get reelected.

All of these other countries approving the deal on everything but the merits of Microsoft's own arguments for the deal. Unfortunate, but that's the way the world is.
 
My guess is they either close and then deal with CMA, or agree to extend until CMA decision becomes final one way or the other.

At this point I'm expecting them to close the deal with CMA approval in some fashion. It just seems doubtful they would have fought the FTC if they cared about CMA or didn't have some inroad to getting that decision changed.

I'm certain they close the deal and hold ABK separate while the CMA Appeal is in flight
 
If the deal is closed, I think Microsoft will keep their promises if for no other reason just because it's financially the right thing to do.

Still not a fan of the deal, but maybe it won't be as bad as we are making it out to be.

I guess we'll just have to see. Either way it's fun to watch meltdowns. If you don't go too hard for either side you get to enjoy today.

Yeah a ruling that the FTC "has not shown a likelihood of success on the merits" absolutely scuttles any hope of appeal.
 
The hypocrisy on display is astounding.
Most folks didn't pay close attention to the trial. They don't know any better. This is the obvious move. WTF are they supposed to say?

"Now we hold all the cards, you pityful wretches will bow to your new gaming overlords, muhu muhu muhuhahahahhahahaa".

the Court finds the FTC has not shown a likelihood it will prevail on its claim this particular vertical merger in this specific industry may substantially lessen competition. To the contrary, the record evidence points to more consumer access to Call of Duty and other Activision content. The motion for a preliminary injunction is therefore DENIED.
 
The US hasn't blocked a vertical merger in decades. This wasn't gonna be the one to break that run.
Well I didn't even think on those terms I was just looking at it as the FTC completely ignoring everything Microsoft had put on paper in regards to COD. If that wasn't enough you then had the CEO under oath telling the judge it makes no sense to exclude it from other platforms.
 
The judge went on record during the trial stating that consoles will be extinct and that the cloud/streaming is the future, based on information the FTC and MS provided to the court.

Oh wait are you saying the CMA has new ammunition or MS? I thought you were saying MS has new ammunition.
 
When this deal finally goes through all the execs that shepherded it through on the MS side deserve a gigantic bonus and some hefty time off. What a job they've done.

No, the CMA has new ammunition if CAT kicks it back, but...

The CAT doesn't agree or disagree with CMA findings, it doesn't even care about the findings, it only looks at the procedure used to get to the finding.
And CAT has not kicked anything back yet this year to the CMA and found they did everything proper, so far...

Of course he's a fan of Microsoft. Did you not see his tweet when the deal was initially announced. Shades of "mission accomplished".
 
That's not going to happen. You'd have to be an idiot after seeing those e-mails to think anything outside of CoD would continue to be found on PlayStation.

It's up to Sony to negotiate it though. Jim tried to go too hard demanding all of Bethesda and Activision games go to Playstation... he probably didn't think MS would even get to this point. If i were them i would have a serious sit down with Microsoft belly up to the bar trying to make this as advantageous for both parties as possible. Ball is nearly in their court...
 
You should tweet this to the FTC, I'm sure they haven't heard this one before.


The FTC is looking at all angles on how to delay the acquisition for another 7 days, after which ATVI's shareholders will need to decide whether or not they want to accept much lower profits per share than they were getting a year and a half ago.
