Not really...it's probability of a probability vs. probability of a certainty, and the law is written to test the former.

Legally, that's a big difference and beyond semantics.
Then that law is written incredibly poorly.

Might as well have said "they might might do it".

I have serious doubts this will be the FTC's argument. And if it is no way they win. I'll stake my reputation as a non-lawyer on it!

What's the FTCs option here? Do they need the injunction to be heard before Friday or Monday, or can they still wait until after Monday?

The existing temporary restraining order expires at 11:59PM PT on Friday, so they need the 9th circuit court to grant their appeal request before that at least. Otherwise it could leave the door open for MS to attempt closure by Monday.

To my limited understanding at least.

Yeah, that may have changed in recent years. Trump got a lot of judges through in his term. Depends on the three-judge panel they get.

You guys do realize that a liberal court going against decades of precedence and case law in vertical mergers is just asking for an appeal to the supreme court? If the case goes to the supreme court say goodbye to antirust.

In my prediction the appellate court won't even grant the emergency stay.

First, it's not just a one time pay out of $3000. It's $3000 per year.

Secondly, if a giant corporation is balking at paying an extra $3000 it means hint hint, you're a shit employee. lol

You are arguing about $3k a year for a $2.5 trillion dollar corporation. If you want to delude yourself and believe layoffs have to do with performance then that's just you. Layoffs are about satisfying stockholders.
 
They are a 2.5 trillion dollar company not a charity (or the govt). Getting rid of dead weight is a good thing no matter the size of the company. They only add more work for the productive workers that have to make up for their deficiencies
