I don't think the deal is still alive. i think Kotick is taking the money and has refused an extension, and Monday's CMC at the CAT will be to formally withdraw from the appeal process followed by Microsoft announcing they stopped their merger.

Beating the FTC was just bragging rights IMO.
No disrespect intended, but this comes across as copium.

No one ever hires an army of lawyers at $1500/hr for bragging rights.

Yeah MS knows they need to wait until the CMA agrees. If they close before then they risk antagonizing them.
I agree with that but as far as the cma is concerned if ms really wants and feels it needs to acquire act this will be handled and closed imo. At the end ms gets what it wants makes some concessions the cma looks like they did there job etc

That is tame.

"Never ask about Ohio".

I mean. We were talking world leaders, not everyday men and women. But ok. You want to play like that?

Set this guy on egg if he tries to close.

Kottick would be stupid if he does that. Plus he is not in position to walk out. The shareholders have to approve it.
AFAIK, it is the opposite way around based on the breakup date in the SEC filing. To go beyond he probably needs shareholder approval because ATVI is worth a different amount today than it did 18months ago.

It's just showing how the FTC lacks the power to actually do anything which has kinda been a thing for a long time...even before Khan got her position.
...and people want to weaken them further. At least for this acquisition. I do wonder if those people will feel the same way if/when someone like Apple starts buying up large publishers.

Lina approach was deemed unfit from the start, plus her appointment was nothing but a theatric.
They need an experienced people.

This happened during her reign. She lost experienced people.

I hope this is sarcasm.

Microsoft in particular seems to have deep and lingering asspain towards Apple after the way they got humiliated out of the mobile and music platform markets.

I predict we will see a lot of shill shrieks if Apple enters the traditional gaming ring in any way shape or form.

I mean, what do you pick. 67B payout or measily 3b payout"?

Kottick is smart and knows how to make more money. He wont settle with 3b payout.

Ah, yes, the Ballmer years...where digital music and pc gaming escaped into the arms of others.

Nice job, Microsoft.

Short sighted dumbasses. Amazon, Apple Meta and Tencent could throw 400bn into the market and regulators wouldn't be able to touch them. The future of gaming is fucking bleak by the authors of embrace, extend and extinguish.

The CMA aren't moving on this for 6 weeks. It is blocked and the deal fails unless Kotick extends. I don't think he will, but it is a 50/50, so why would it be sarcasm?

Why wouldn't he extend ? you think he'll want activision to get 3 billion instead of 68 ?

It feel over and ready to close to me. Timing of the CMA announcement(s) too much for me to believe otherwise. Just the tip never stops at just the tip. :messenger_open_mouth:

Feels to me like a settlement of some sort was agreed and the two parties are just going through the motions to enact it according to the ruleset.

Because unless something happens( which could) the deal is closing. Microsoft didn't do all this so they can lose 3 billion and renegotiate.
Step back and look at the situation.

I am welcome for that idea.

"The new PS6 will launch with a price tag of $1500 with apple logo".

The next week headline after launch would be.
" The PS6 sold 30m copies in 1 week, making it the most profitable console of all time"

It was really over the moment Corley ruled on it. Then some guy on Twitter started spewing out CLAYTON ACT CLAYTON ACT as if it A) isn't ridiculously old and B) isn't open to interpretation.

And that guy was a lawyer, so of course everyone starts acting as if lawyers are all-knowing Prometheans, rather than flawed, overworked, and deeply alcoholic individuals.

Come to the UK and see the way our laws work, how our civil service works. The CMA and CAT aren't breaking laws to throw out a 500page report that blocks the deal and Microsoft aren't stupid enough to close over the CMA.

Either Kotick extends or the deal dies on Monday IMHO. That is the two credible options left on the table.

Well, it looks like it ended there in hindsight. But for me it was the CMA taking a look at something new timing. That's when it just felt like things changed big time.

I agree, no tech deal can get blocked by any of the regulators now, they will use this deal as a precedent.

Is it bad that im kind of hoping if this does kick off acquisition stuff, its Amazon that goes on a spending spree and adds it into Prime. At the very least they would keep it 3rd party. Im not a fan of Microsoft or Sony acquiriing any Publisher level

Would love to find out what the divide was.

I have a feeling all 3 voted against the FTC.

Bet you're right. Look at how ridiculed it was from all notable press outlets and most legal experts.

I'm completely serious about the FTC seeing that Clayton Act Tweet Guy and then going "huh, maybe we should appeal?"

They're that in over their head.

That is not going to be an issue according to the market right now.

Unfit in what certain ways? Harsh, yes, but that doesn't mean it is necessarily incorrect or wrong. Mostly a product of brokenness

Are you in a cave right now"?

Gaming is fked up right now and is in a dire situation. This deal has been distracting people from the awful practices that has been going behind the scenes.

All the people insisting that the appeal will be granted because Corley said "will have" instead of "may have".

Why would Apple need the PS6? They have their own engineers and currently the M2 chip. They could probably do a hell of a job if they decided to bring a console to market. I would not be able to afford it but I could envy those that could.
