There are countless valid reasons why this deal is bad. None of them are legal ones and if they were used to block the deal, they would be unfair in the sense that they are not applied to all deals and do not apply to existing organizations. Consolidation is objectively bad for consumers across every industry as an average but on a case by case basis it is really hard to have a smoking gun to say it is objectively bad and every industry has been consolidating from the point where it became viable because those efficiencies lead to improved affordability and quality. Where can you fairly and consistently draw a line?

It will be very interesting to see how far Microsoft are willing to go with their proposal, it will be demonstrative in showing how desperate (or not) they are to get this deal to go through.

What of all of the the reports that the CMA and MS have come to an agreement on MS's proposal? What a bunch of shady reporting
 
If the CMA hasn't even received the final proposal what are they going to tell to the CAT judge as proof that there is reason to pause the appeal?
They should have done so already yesterday?

Maybe they've already done that. The evidence wouldn't necessarily need to be the final proposal, obviously MS and the CMA have had discussions about what MS is going to try and put forward. They likely think there is a good possibility that the proposed changes could work, but they haven't seen it in writing yet.

The reporting on this, in general, has been shady from the get-go, especially from the gaming media.

I don't know this, but I'm starting to think that these lawyers are in the habit of overselling their position in front of a judge. Like the whole "the deal dies tomorrow if we don't get this adjournment" bullshit. Hard to know what is actually truthful and what is hyperbole.

I think the GP numbers are gonna be at or above 40 million just by the virtue of Live Gold being turned into Game Pass Core in a few weeks. So that part won't be a problem without needing to account for new sub sign ups in lieu of Starfield and/or Activision.

Ah, good point. Then they should be at or over 50 million GP subs by the end of this generation.

I remember when a certain other combined their subs into one naming convention (brand) of tiers which caused their sub numbers to be over that, and it was called "dishonest." That 30+ page thread was a hoot looking back.

Gotcha. I didn't mean PS3 come back in the way it ended up over taking the X360. That was my bad. I meant a revival in the sense that Sony made it very clear that they started off bad, but by the end of the generation, it was 100% obvious that they knew what they were doing and they were in great hands going forward. You could see the confidence in the execs and you could see it also in the numbers too.

1. Sony didn't force Square Enix to make Final Fantasy a timed exclusive... they simply bid and Square Enix agreed. Square could have simply said no and moved on with their day, or Microsoft could have matched the bid or bid more.
2. Starfield was never going to be exclusive, it was going to be a timed exclusive. This means it would have been released on other platforms 6 to 12 months later. Yet again, Microsoft could have matched the bid or made a better offer.
3. Every gaming company has done the same thing Sony has for decades, so I have no clue why Sony is getting singled out.
4. Microsoft is literally buying other studios to make them exclusive, which is way worse than what Sony has done. Bethesda was not an exclusive studio before Microsoft bought them, but Phil has just made them an exclusive studio. If it weren't for the money COD gets from Sony, they would have completely shut Sony out of the COD deal. And if Nintendo wasn't as big as they are, they would have completely shut them off.

Microsoft is preaching about wanting everyone to play their games, but they're going in the direction of making them exclusive, which potentially shuts out millions of users and forces them to spend a crap load of money to play on their system. And that judge is adamant that this deal is good for gamers.
