It will be very interesting to see how far Microsoft are willing to go with their proposal, it will be demonstrative in showing how desperate (or not) they are to get this deal to go through.

Rumor is it's a divestiture of the IP Licensing Rights for ATVI games for Cloud Streaming in the UK

Typically I go to bed around 11 every night, so I'm well-rested and energized for work the next day.

Last night, I got into bed at 11 as usual, but when I closed my eyes, I just couldn't fall asleep. My mind was racing. The Xbox Series X is not only the most powerful console ever created, but it has such an elegant design.

I tossed and turned in bed. I could not get comfortable. How could I expect to just drift off to sleep knowing that next November, just 11 months from now, gamers will get to experience true raw power, right from their living rooms?

I called up my girlfriend, who goes to bed at 8pm (as women do). "Hey babe," I said. I could hear her shifting from her sleep. "I can't sleep. I keep thinking of how powerful Microsoft's latest console, the Xbox Series X is. Never before has a home console been a 12 teraflop powerhouse before and contained 13GB of RAM."

"Babe," she said, "it's 11pm. I need my 16 hours of sleep so I can face a full day tomorrow of being indecisive about what I want to eat for every meal. Why are you so concerned with such raw power so late at night?"

I howled with disgust. "Woman, listen to me," I screamed into the phone. "It is not every day that such a powerful console comes out. There has never been a console with such speed, yet such elegance, and there never will be again, at least until Microsoft makes the next Xbox. If you cannot understand this situation then perhaps we should see other people."

With that, I hung up on my ex-girlfriend and chucked my iPhone across the room. It smashed against the wall and landed into a pile of my other broken iPhones. Now I am exhausted at work and the Xbox Series X is still the most powerful console on the market.

Doesn't really matter what it "feels" like though. What matters is what it is under the law. FTC tried regulating with "feels" and "vibes". Hasn't really worked out for them so far.

Of course it matters what it "looks" like (I didn't say "feel"). CMA's integrity is already being questioned. And there is no law saying CMA cannot adopt behavioral remedies so I don't get your point. I didn't say this was illegal.

1. Sony didn't force Square Enix to make Final Fantasy a timed exclusive... they simply bid and Square Enix agreed. Square could have simply said no and moved on with their day, or Microsoft could have matched the bid or bid more.
2. Starfield was never going to be exclusive, it was going to be a timed exclusive. This means it would have been released on other platforms 6 to 12 months later. Yet again, Microsoft could have matched the bid or made a better offer.
3. Every gaming company has done the same thing Sony has for decades, so I have no clue why Sony is getting singled out.
4. Microsoft is literally buying other studios to make them exclusive, which is way worse than what Sony has done. Bethesda was not an exclusive studio before Microsoft bought them, but Phil has just made them an exclusive studio. If it weren't for the money COD gets from Sony, they would have completely shut Sony out of the COD deal. And if Nintendo wasn't as big as they are, they would have completely shut them off.
5. Microsoft is preaching about wanting everyone to play their games, but they're going in the direction of making them exclusive, which potentially shuts out millions of users and forces them to spend a crap load of money to play on their system. And that judge is adamant that this deal is good for gamers.


Your number 3 point is what's driving me crazy! And many in the videogame media are acting as if Xbox didn't win bids to make AAA games exclusive or timed exclusives too.

You keep referencing "the law" so if you have a law you want to cite to make some point then please do. I already said none of this was illegal so....

But why lie by omission something that's SOOOO obvious? Some of these Xbox deals also happened within the last 10-12 years. It's not like the truth is hard to fine.

Sony aren't being singled out, previous documents have also mentioned Nintendo games as well, it's just part of the lawsuit and discovery. If Sony has similar litigation in the future for a big acquisition, I'm sure they'll be busting out documents with competing exclusivity deals as well.

MS hasn't really shut down anything. FF XVI is PS exclusive. We still see games going to Game Pass for a year and then coming to PS. And, of course, the Indiana Jones deal. It's the same shit it has always been. Sony does exclusives on a bigger scale because they can. Just like MS buys shit on a bigger scale....because they can.

It is really ridiculous for anyone to try and white knight either of these companies. The best you'll ever do is argue which company sucks less.

And like they wont win AAA bids going forward. Getting ABK wont Sony, Nin, and MS going after 3rd party exclusives.

Dead Rising 3 and Street Fighter 5 are both Capcom titles and they were both console exclusive titles.
Titanfall was Xbox exclusive and never came to PlayStation 4.

Having third party developers make exclusive games for a platform has been around before Sony entered the market. Xbox has been doing exclusive deals ever since the OG era.

Do you know they signed an 11 game exclusive deal with Sega? How about all the exclusives from Bioware? Tecmo for Dead or Alive 3?

You guys try so hard to make MS out to be the victim. You guys get your talking points from Xbox fans on twitter and come here with this nonsense.

So I've been wondering, does the CMA not get the same access to MS documents as the FTC seeing as it's a US company?
They dropped their SLC on consoles on a miscalculation that showed no incentive to remove COD but during the FTC hearing we had the Denali model documents and emails which was the acquisition model suggesting the incentive and likelihood was there. So why did the CMA rely on some incorrect shot in the dark calculations they made up? It was right there in the documents already done by MS themselves.

1. Microsoft simply could have matched Sony's bid or outbid them to make Starfield a timed exclusive, but they chose to buy them to make them exclusive, which is way worse.

2. And yes, they're only staying on PlayStation and going to Nintendo because it'll make them a lot of money. Yes, it would have made money on Game Pass, but it would have taken them far longer to cover the costs. It wouldn't surprise if they completely shut out Nintendo and Sony in 10 years' time.

3. Mostly all the people have been saying," oh, but Sony has been doing it for years so Microsoft had no option but to buy companies out so the horrible Sony can't make games exclusive." Yet, Sony has really only been renting these games out.... and those companies were happy to take Sony's money to make them timed exclusives. They could have said no, or the other gaming companies could have matched the bid or outbid Sony. Even the judge didn't seem to care when she made the comment about it being potentially bad for Sony. If it were the other round, this deal would have been blocked for Sony.

Same for exclusives, Devs accepted Sony or ms money because they though it was enough, when Sony brought a studio the studio was happy to get the money, no one is being forced, the companies were willing to sell, the same when you go public, you know anyone can try an hostile takeover it's your duty to keep 50.1% ownership. In the end the market will balance or collapse and start anew. When someone get greedy someone else step up.
