I thought it is still a strike out regardless if the catcher has position if the batter swings?

The question is if it's a foul tip or a foul ball. Foul ball dead, foul tip strike. Bad call, but doesn't matter anyway.

foul tip implies he holds on.

The ump called it a foul tip off the bat.

Meaning that the only way it could be an SO is if the catcher actually catches the ball.

If he swings and misses completely, and the catcher drops the ball, then the runner could run to first and reach. It would go down as a strikeout and the runner reaching on a passed ball. The catcher then either has to tag him out or throw to first in time to get him out

Technically speaking the it's only called a foul tip if it's held on to. It's a foul ball if it doesn't. So the ump called it a foul ball since it was dropped.
