my drivers are all up to date. BUT something strange is going on
some places (such sas the mass effect 1 config options) list my graphics card as "Intel(R) HD Graphics Family"
but my grpahics card is Nvidia geforce GT 540M

Your issue is that your onboard video is being picked up over your nVidia card. Intel integrated cards are crap, which is likely why it won't run. Why this is happening? Fuck if I know. Try disabling your Intel graphics.
Edit: I should warn you that if your computer is using the Intel over your nVidia then disabling it will cause you more problems.

Yes and I have eyes of my own, I can decide what looks the best. Twitch's never looked even remotely close to some streams on own3d.
