Utah judge orders baby removed from same-sex foster parents

There has to be something missing in this report.

1) Gay couple foster a baby
2) Everyone involved (baby, foster parents, biological mother, attorneys) support the gay couple fostering the baby
3) Judge randomly gets involved
4) ???
5) Baby is taken away

How can the judge legally preside over this if there was never a case in the first place? He's just allowed to do this because he's in some way connected to the case workers?

It says the biological mother's parental rights are being terminated. I assume they need a judge to sign off on that?

Pretty much this. So one mother = OK, two mothers = bad?

You can't be going around calling gay people mothers now can you. The proper term is 'sinner'. Having gay sex around kid all the time will make the kid gay too.

This is not the first time Johansen has been in the news for making controversial rulings.

In 1997, he was reprimanded by the Utah Judicial Conduct Commission for "demeaning the judicial office" after slapping a 16-year-old boy who became belligerent during a 1995 meeting at the Price courthouse. Johansen knocked the boy's hat off his head and slapped his face.

Johansen was also criticized in 2014 for ordering a Carbon County mother to lop off her 13-year-old daughter's ponytail as punishment for the teen cutting the hair off a 3-year-old girl at a McDonald's.

Johansen told the 13-year-old's mother she could shave 150 hours of community service off the sentence if she cut her daughter's hair in court. Troy Williams, of Equality Utah, called Johansen's decision "outrageous and unconstitutional" and said it unnecessarily harms the couple and the child.

This is super fucking confusing. As people have already pointed out, how did the Court get involved?

Further, it is implied that these studies were not submitted as evidence by either party (if they were, they'd be citable). If so, how on earth did the Judge come to rely on them in his ruling?

How? It takes some time or whatever to get this case before a better judge and fix the situation but that doesn't matter to the judge. He has boosted his family values credentials which will see him win re-election which is probably all he cares about.

Yep, rip a child up and out of their home and back into the system, that's an awesome idea that surely is the better option than having them raised by a same-sex couple. Fucking asshole.

That is seriously one of the most disgusting things I've ever fucking read. Taking a child out of a loving home because of your prejudice? Holy shit. I'm actually annoyed, and it's damn hard to annoy me.

Yup. There was a huge campaign here in Iowa to remove the justices on the state supreme court after they legalized same sex marriage in 2009. Sadly, 3 of of them were up for retention in 2010 and all were voted out of office. The Justice who was up for retention in 2012 kept his position though.

Fucking midterms, I swear.

In Utah judges are appointed by the Governor and ratified by the state senate. Then every 7 years they face retention ballots where they must receive a majority of votes to keep their job. Or they can be impeached or removed by an oversight committee.

I wonder if this has something to do with the troubles with the Church of Latter-Day Saints. It IS Utah. I know someone in the LDS's Church, and we've had deep talks about what is going on in Utah, and the church right now. I respect their POV, but imo they and the judge in this case are horribly, horribly wrong.

Thanks for the explanation. I saw the part about the oversight committee but missed that there are public elections for judges at that level.

The most recent report said that he puts personal beliefs ahead of law. You don't say.
