Tom Brady's Suspension Appeal News

someone correct me if im wrong but im fairly sure they originally wanted JUST his texts but he didnt hand them over either?

Not even that. Wells said in an interview initially he only requested paper copies which could be pre-selected by his lawyer and they wouldn't even cooperate with that. I mean I can understand not handing over your phone but why not paper copies of texts you decide?

He's hiding something else. I obviously don't know what but it has to be bigger, to him, than just deflated footballs.

Maybe he is cheating on his wife or using PEDs but I find it weird he'd act this way over something like deflated footballs.

I think there was more stuff in that phone too, why not just delete the text messages with the other dude? Destroying the phone hints at that the phone must have more stuff on it...

Because it's a ridiculous request. They already had phone records for the people who handled the footballs.

His phone wouldn't have ended up in the "hands of the NFL" but in the hands of Renaissance Associates, the company contracted by Ted Wells and the law firm Paul, Weiss, Rifkind, Wharton & Garrison LLP to gather the relevant data from McNallys and Jastremskis phones for the purpose of the independent investigation.

In an investigation controlled by the NFL. Regardless of that however he had ample reason to be concerned for his own privacy. It only takes one person to copy something or snoop outside the bounds of the investigation. Denying this is silly.

How about this for reasoned analysis...What did destroying his phone actually accomplish when they can just retrieve the messages from whatever carrier he uses if it went to court? It's a panic move. Why would he be panicking? Because he didn't want the NFL to read his sexy time messages with Gisele? Or, was he trying to hide evidence of his guilt?

You're the one claiming it means he's guilty, not me. You need to show why he did it. I'm saying there is obviously more than one reasonably possible explanation.

Again, they have the other phones. There was nothing on them.

If I was famous, my wife was even more famous and my child's mother was also kind of famous - why hand your phone over to a private company with no oversight? His family's privacy is more important than the assumed 25k-50k fine that Brett Favre got.

If he knew how bonkers Goodell would go with the punishment maybe he'd have reconsidered, but no one could have predicted that.

It's not like the investigation didn't get the phones of the people he was suspected of having contact with anyway. If you have one sides text history you don't need both.

That's assuming they have all the other sides.

Everyone in football is trying to hurt someone else. What the league did to the Saints was pitiful.

Hurt someone is one thing. Aiming for a specific bodypart, or injury that could result in a career-ender is a 7-layer dip of fucked up. They deserved everything they got.

I honestly don't want anyone besides me having my phone, and I'm just a dude

He's entitled to his privacy. They had no evidence and it was nothing but a fishing expedition.

then, as the poster above you stated, why not hand over paper copies after selecting which ones he wanted to send with his lawyer?

I honestly don't want anyone besides me having my phone, and I'm just a dude

again i think its pretty key to remember the request for his cell phone was AFTER they said just pick some texts and send us paper copies. which he didnt do.

He got off very, very easy.

This wasn't a criminal offense. There's absolutely no way in hell Verizon or whoever would pass along his messages without Tom's consent, and given the dude destroyed the phone to prevent them from looking at them, he obviously wouldn't have agreed to it.

Doesn't have to be a criminal case. If he sues the NFL they will be able to defend themselves and be able to subpoena the phone company for the text messages.

If the Patriots bought him the phone (could be very likely) then Kraft could sign off on it.

Even in an instance like this where that is even a possible theory, Kraft wouldn't do this either because it would undermine his player and very likely negatively affect their chances with free agents in the future. Destroying the phone meant they didn't and won't get his texts. End of story.

BREAKING: @NFL asks federal court to confirm Tom Brady suspension. Complaint filed in Manhattan #sportsbiz #NFL #preemptivestrike

Seeing you in these threads makes me so sad. You're better than this.

They deserved more than what they got. That said, poor punishments given previously doesn't mean future punishments must suck as well.

Thank you Mr Brady for all you have done.

Give him a hand.

Pats fans have nothing to worry about. If Brady is innocent, he'll just take it to court! The NFLPA is just waiting for Brady's go ahead!

Brady will bring this injustice down! He has nothing to hide Pats fans! Sit tight! Any minute now!

Wow, NFL coming down tough.

Glad that Brady "more probable than not" that he knew about deflated footballs is considered as bad as:

Hardy picked me up and threw me into the tile tub area in his bathroom. I have bruises from head to toe, including my head, neck, back, shoulders arms, legs, elbow and feet. Hardy pulled me from the tub by my hair, screaming at me that he was going to kill me, break my arms and other threats that I completely believe. He dragged me across the bathroom and out into the bedroom. Hardy choked me with both hands around my throat while I was lying on the floor. Hardy picked me up over his head and threw me onto a couch covered in assault rifles and/or shotguns. I landed on those weapons. Hardy bragged that all of those assault rifles were loaded. Landing on those weapons bruised [my] neck and back. Greg screamed for his “administrative assistant” (Sammy Curtis) to come into the room and hold me down. Curtis came into the room, grabbed me from behind and held me down. Hardy and Curtis then took me into the living room area. I wasn’t nearly strong or fast enough to escape. I begged them to let me go & I wouldn’t tell anyone what he did. They took me out into the hall, pushed me down & went back inside his apartment. I crawled to the elevator and ran into CMPD". (Charlotte-Mecklenburg Police Department)

(Affidavit from Greg Hardy's girlfriend. Hardy's suspension was recently reduced to 4 games)

Additionally, "more probable than not" knowing about deflated footballs is worse than driving drunk, crashing your car, and mumbling incoherently, while drunk, to police:

http://www.nfl.com/news/story/0ap20...mith-arrested-booked-after-crashing-into-pole

According to a report released by the Kansas City Police Department, the arresting officer stated that Smith "appeared confused" after the accident and "began mumbling statements that I did not understand." Smith declined medical treatment at the scene.

Smith was cited with operating a vehicle with .08 percent or more of alcohol in his blood and with driving a vehicle in a careless manner. He received an additional citation for failing to present proof of insurance.

(Smith received 3 game suspension)

Also worse than 2 counts of felony firearm possession, felony marijuana possession, and $200,000 in cash, which got Letroy GUion a 3 game suspension.

But, these are all off the field so, I suppose, on the field issues are worse than off the field, right?

Well, in the last few months, the following players received 4 game suspensions for PED use:
Derek Wolf (Denver), Antonio Gates (San Diego), Victor Butler (New York Giants), PED violation.

League sticking to it's strong assessment that "more likely than not" that Brady knew about deflated footballs is worse than PED use, drunk driving, felony weapons charges, and beating the piss out of your girlfriend while throwing her on a stack of guns.

Reports Brady had his assistant destroy his phone. That's so insane. Definitely can't be trusted, but then you think that this is for being "more probable than not knowing about deflating footballs" and you're like "lol wut?" I just want Brady to take the punishment and see what Garopollo is like.

He's entitled to his privacy. They had no evidence and it was nothing but a fishing expedition.

I don't think anyone is saying he isn't entitled to his privacy or he did something illegal, but don't insult people's intelligence by using court of law reasoning.

Anyone with with an ounce of intelligence knows the actions of a guilty party when they see it.

Umm, everyone aims at specific body parts. Especially if they know someone is already injured. There's a reason the suspensions got overturned by the courts. They were fucking stupid.

You're better than this Albatross. Stop comparing apples to oranges. Here's my previous post,
People really need to stop comparing this penalty to the wife beaters and DUI penalties like they're on the same spectrum. Bringing the integrity of the shield into question is a lot more offensive to your employer than the fuck up you had after hours. Sure beating your wife makes you a worse person than the guy deflating footballs, but one is fucking up your bosses product and the brand of your company while the other is just fucking up the athletes brand/name.

Funny thing, Smith just got his suspension reduced from 3 to 2

Is the only argument people have against 4 games "BUBUBU WIFE BEATERS GOT THE SAME"

We get it. we all agree thats insane i think.

The difference is I think the wife beaters should get more not tom brady get less.

Basically.

It's bad PR but that doesn't make the suspension bad.

If anything they got lucky only Tom got caught up in this because they basically sacrificed him.

I'd have no problem with them suspending Hardy forever, but saying that he only got 4 games is a bit disingenuous. Yes, the NFL reduced his suspension to 4 games, but Hardy was forced to sit 15 games last season.

Wife beaters should be handled by the court. A company should not punish you for what you ALLEGEDLY did on your own time that doesn't really affect the company. Especially a monopoly like the NFL. Why should these guys get sentenced twice? Why should I lose my job in an industry where there is one company because of what somebody accuses me of. Why the fuck do we even have courts?

yeah, one is you fucking up after work. the other is you fucking up while on the job.

Well said. I completely agreed.

Also I think it's important to make the distinction that wife beating happens outside of the NFL's jurisdiction. What Brady did here was precisely related to the NFL.

Cause the NFL and sports teams are also a brand, your actions outside of work can mess with that brand.

You're better than this Albatross. Stop comparing apples to oranges. Here's my previous post,

I'm not better than this!

I disagree with you that probably "knowing about deflating footballs" is worse for the product of the NFL than it's storied history of domestic abuse. I have a hard time thinking that Ray Rice, Greg Hardy, and Adrian Peterson have not done a lot more damage for the NFL product than Brady probably knowing about deflated footballs. The product of the NFL is not just what's on the field.

But, even regardless of the off field issues, the penalty conflates PED use with probably knowing about deflated footballs. That's certainly a strong condemnation by the league.

I'd have no problem with them suspending Hardy forever, but saying that he only got 4 games is a bit disingenuous. Yes, the NFL reduced his suspension to 4 games, but Hardy was forced to sit 15 games last season.

But just by his team. Correct me if I'm wrong, the NFL did not suspend Hardy last season. Same with Peterson for the Vikings... Those were team suspensions. I might be wrong, but It hink Greg Hardy still received his $13million salary. So, sure, his team benched him for 2015, but still paid him $13million -- which he wouldn't have gotten had the NFL suspended him.

Is the only argument people have against 4 games "BUBUBU WIFE BEATERS GOT THE SAME"

Nah, I have many other arguments for why 4 games is ridiculous for "probably knowing about deflated footballs" regardless of other suspensions, but pointing out the obvious hypocrisy of the NFL is easier.
