I guess that the Patriots are not playing along with the judge's request for all parties to tone down the rhetoric, not that they are under any responsibility to.
 
Hopefully people now realize what a colossus joke RG is based on the recent leaks and now these emails. The Pats suck and are fun to hate on, but this guy is infinitely worse.
 
I don't know that people still believe the NFL has a good case after the NFLPA filed suit. Here's a good summary:

I personally think this is now bigger than deflategate. If the NFL win's this may set a very dangerous precedent for all players in the NFL:

  • NFL can suspend you for being 'generally aware' (never been done before)
  • NFL can suspend you for non-cooperation, i.e. not providing your private communication (never been done before)
 
What did they do?

I guess they didn't comment on them, but they released a series of emails between Patriots employees and Jeff Pash (NFL General Counsel) asking them to address the erroneous leaks, generally met from Pash with silence or snideness.

It kind of destroys the narrative that the Patriots weren't cooperating with the investigation early on, as well.

They lying about the source of the leaks is pretty revelatory too.

The Patriots aren't involved in that case. It's the NFL vs the NFLPA

Yeah, how dare he destroy a phone he was told they didn't want. A phone the NFLPA would never let him turn over regardless.

Except Goodell punished Payton for Bountygate even though he wasn't aware of it. Goodell's always had that power. Pats fans were all on board with this when he was hitting Steelers players with fines and one game suspensions for "hard hits" arbitrarily or hitting the Saints for Bountygate.

There's a clause basically about "morality and code of conduct" in the CBA that lets Goodell punish someone for everything that isn't specifically defined in the CBA. See: Ray Rice; or whenever someone gets punished for a game for like having a DUI in between weeks (even though it's not written in the CBA that a DUI gets you suspended for a game). It's basically Goodell's "protect the brand" power.
 
The NFL expertly played the phone thing like it in any way mattered and people eat it up as proof of Brady's guilt. The only thing the phone is is a way to distract people from the fact that the NFL investigation turned up nothing incriminating and they don't want people to know that they wasted months of everyone's time on nothing.

see second part: CBA has a "morality & everything else" type of clause that covers anything that isn't explicitly spelled out. The NFLPA lawsuit is basically going after that power. That's where Goodell is getting his "authority" (I use that term loosely) to hit Brady. It's why Steelers players used to get fined/suspended for a game for basically hitting people too hard.

EDIT: I agree (and think Stradley rocks as a side note) with Steph Stradley in that this is a) all something that has been coming for a while and b) Goodell should never have been trusted with this kind of power. There's a bit of racial / class jealousy involved in this whole thing from the beginning - people forget that Goodell got this authority because the fans wanted someone to "clean up the NFL" from all these "terrible players getting arrested all the time", even though its been shown that NFL players get arrested at a far lower rate than the average person. But primarily white fans and primarily black players; was easy to justify the NFL (and to a greater extent, the NBA) being full of thugs and needing "discipline".

Brady's suspension is based on his general awareness of ball tampering and failing to cooperate by handing over his phone, as far as i am aware no player has ever been suspended for those two infractions regardless of which clause the nfl chooses.

Roethlisberger got suspended even though he was never convicted of anything. There's never been rhyme or reason to goodell's punishments. Never has been. I have no sympathy because if that were cam newton instead of Tom Brady; the outrage level would be non existent.

Vilma's suspension was overturned - twice. Roethlisberger was suspended for "...contribut[ing] to the irresponsible consumption of alcohol by purchasing [or facilitating the purchase of] alcoholic beverages for underage college students, at least some of whom were likely already intoxicated."

This is a commissioner that threatened to suspend Marshawn Lynch for the Super Bowl if he wore gold cleats. Look at the surprise on my face that he suspended Brady 4 games for gamesmanship + mouthing off back to him. If he really wanted to punish Brady; he'd mandate that NE is not allowed to touch their footballs before the game at all indefinitely.

I'm super curious to see if the NFL punishes the Patriots for publishing the emails. The teams are forbidden from badmouthing NFL employees in public; supposed to just tell the commissioner.

That said it will be 2 games and no admittance of guilt. No one will care by 2nd week of September.

This is a well thought article though it doesn't cover all the bases.

Brady also could have been a pedophile, he could have been cheating on his wife, involved in other cheats or crimes, etc that were not relevant to the investigation. He is protected under the 2nd Amendment for guns or privacy or something and the NFL should not use the fact that he did not want to turn over his phone as a negative inference considering there are so many legitimate reasons for it.

The Wells Report has also been vetted by multiple lab scientists. Different scientists have different theories. What's your point?
