'Killzone: Shadow Fall' Class Action Lawsuit Can Proceed, Judge Rules

So I'm going to start a class action because all game boxes say 1080p on them. We all gonna be rich! Whose with me? Anyone? Hello?

What was the false advertising with Halo and AC? The dedicated server thing in Halo? Well they have a good defense to that, in that they're working on it. Not really worth bringing a case for. Otherwise, I don't see what they'd sue about. You can't sue because you bought a broken game. People buy crappy products all the time; just because it's crappy doesn't make it illegal.
There's a difference between being crappy and being broken.

Eh, and I thought people could not get more dumb. Sony itself has quite a bad luck too.
If he wins, I also want a refund for every Ubisoft game.

They just want money but let's be honest, you know why devs can get away with shit? Because we allow it.

Hopefully stuff like this sets a precedent that even something as minor as 1080pr shouldn't be allowed to get by.

Shadow Fall is a bad example though. Now I don't remember the details but the "problem" came from a trick in the rendering technique. Among all the not-1080p games, KZ:SF is easily the best for that matter lol. Multiplayer only, the single player is native 1080p

Can someone explain how a lawsuit like this happens, but how other games like AC and Halo seemingly get away with it? I mean, I'm shocked Ubi/MS aren't sued already for that. I can understand false advertising in Killzone's case, but it seems someone could just as easily do the same for Halo/AC and with greater success.

Seriously.

Did EA ever get sued for BF4 at launch? I know investors sued, not sure about consumers.

Curious to see the outcome.

If the fans win, wonder if more companies will be more honest with their footage/promises or will we see more lawsuits follow

Definitely more lawsuits.

This actually feels really silly to me. People are THAT upset about the game?

Fucking what.

Someone going to get a lawsuit rolling over the trees in GTA5 on XB1/PS4? I mean, they were moving in the trailer.

Apparently he's never played a game under 1080p before.

I just got back into Shadow Fall and like the game a lot. I hope this guy doesn't win. Of all the developers out there Guriella doesn't deserve this :(

i absolutely hate misleading marketing in the videogame industry, so whatever it takes to make developers and publishers more honest about a game's features or visuals, i'm all for it.

though i'm not sure this is the right game and developers to target.... well, back in 2005 maybe :p

I wonder if someone can file for MCC not working as advertised.

At one point, this is good b/c it'll make pubs and devs think twice before the market something and not deliver.

On the other hand, get a life man.

This Ladore is an idiot and a prime example of how to use the legal system to troll for cash. I hope he does not receive a penny from this nonsense, instead he should be penalized for wasting people's time. Maybe he will follow this up by filing a motion against Ubisoft.

@Tempesta di Fuoco
Wait until you get sued by some moron. No one who is condemning this moron is overreacting. Clearly you don't know what you are talking about.

You can sue for anything in America. It's just that most cases get settled out of court before it even gets to a trial.

MCC seems like a bigger deal to me. I mean, Shadow Fall at least works, right?

*Disclaimer'* Not that I think EITHER deserves a fucking trial, lol.

But the game is 1080p. Even the multiplayer is technically 1080p. It just re-uses parts of the previous frame(s). Still 1080p.

Don't think anyone should make or lose any money out of this besides legal fees, but it would actually be a good thing if a judge did rule on this. It would set legal precedent for games companies to be punished for throwing out bogus info and bullshots. We need that to happen do we not?

This is what doesn't make sense to me. The image being delivered to your TV from the game is 1080p. Is some wizardry being used to make it 1080p? Yes but that's not the point.

Its amazing with all the broken games being released, all the broken promises - this is what a gamer chooses to go after and seek damages.

Oh video game community, you so crazy.

The key question is does it actually say on the box that all features of the game are guaranteed to work on day 1? Common sense and assumptions do not equate false advertising.

Wow loool this should be good... If he wins he probably will just get a refund. Still the whole thing seems kinda werid.

it is 1080p tho.

here's hoping they don't get a dumbass judge or whevever, the technique they used online will be hard to explain.

Ok US-Americans, could you do me a favour? Please sue someone or something to make Top Spin 5 real. Thank you.

It outputs a full 1080p frame.

It keeps internal buffers sized at 960x1080 then using information from the same pixel 2 frames in the past it has a good chance of guessing the pixel information in the current frame.
http://www.killzone.com/en_GB/blog/news/2014-03-06_regarding-killzone-shadow-fall-and-1080p.html

There's an explanation they did that goes into more detail than the blog did, but I can't find it at the minute.

It's a really interesting technique imo.

Edit: These are more slides on the tech in SF. http://www.slideshare.net/guerrillagames/killzone-shadow-fall-demo-postmortem GG are excellent for doing their post postmortems.

I know, I'm (almost) a lawyer :p

I just don't see the cause of action if someone was to sue about the MCC or AC:U.

Well, you should know very well then that a lot of people will sue with no cause of action whatsoever. They sue because they can, or are misinformed, or just plain angry about something.
