Nice find; did not know The Gunk is a permanent Xbox console exclusive. Hope that isn't the case for Echo Generation & Ravenlok but could very well be, too.

Psychonauts 2 with no PS5 version. Hi-Fi Rush exclusive. Redfall exclusive, canceled PS5 version. Starfield exclusive, canceled PS5 version. Outer Worlds 2 announced as exclusive, now they're "not sure". ES6 "may or may not be". Indiana Jones canceled PS5 version. You wanted to make Minecraft exclusive, and sounds like that is still a possibility.
The only reason Microsoft isn't paying for third-party exclusivity like they have in the past is because they went from almost shutting down to now just buying the industry. Couldn't even really be bothered to spend billions contracting third parties to make new games. Acting like they don't have money to compete in exclusivity deals when they've tried to spend almost $80 billion buying companies.

The MS lawyer is, which they should do, trying to paint COD as to big to foreclose. I can't say the judge will care if they will or not in her future decision, which will obviously help MS if she doesn't. But after the first 1.5 days, I find it unlikely she would conclude there's no chance they would. My guess is she will call it a question that must be resolved in the August trial in the first instance. If I'm right, it would be a plus for FTC. They would still need her to believe it matters of course.
