The MS lawyer is, which they should do, trying to paint COD as to big to foreclose. I can't say the judge will care if they will or not in her future decision, which will obviously help MS if she doesn't. But after the first 1.5 days, I find it unlikely she would conclude there's no chance they would. My guess is she will call it a question that must be resolved in the August trial in the first instance. If I'm right, it would be a plus for FTC. They would still need her to believe it matters of course.

There’s also the question of “if Sony allows it” which means terms must be negotiated, and Sony not accepting certain terms could be seen as them not allowing the game.

Well, if you made a statement like that to either a UK or EU regulator and then acted in contradiction, you would have an investigation opened within hours.

That was all pre-planned. The ‘do you swear, under oath’ stuff. That was the headline that they want reported.

Perhaps their deal really is to keep CoD chugging along as the multiplatform money spinner. And I say that as someone who had suspected they would look for exclusivity at some point.

He did answer about ES6. He said "I can't do it now because it's so far away." Then the FTC lawyer read him his previous deposition that ES6 will be an Xbox/PC exclusive.

This is what Ive been saying since they went out and bought Minecraft for $3 billion. You cant complain about Sony buying FF7 and Shenmue when you went out and paid $3 billion on a game that you didnt even need. Then he cancelled Platinum Games' Scalebound, passed on the recently fired kojima, reject Activision's deal for timed DLC they had had going back to 2007 with COD4: Modern Warfare and then he gave square enix $100 million for Rise of Tomb Raider. This all happened in 2015 because the genius had wasted $3 fucking billion on a multiplatform game that was always coming to xbox.

Here are all the studios he could've bought for $3 billion:
- Insomniac - $220 million
- Respawn - $300 million
- Crystal Dynamics and Eidos Montreal - $300 million
- From Software - $800 million (according to recent valuations)
- Avalanche Studios - $120 million
- Gearbox software - $1.3 billion

They couldve had Insomniac churning out spiderman, wolverine and other marvel games. Respawn churning out Star wars and GaaS shooters. Crystal Dynamics churning out Tomb Raider games. Eidos making Deus Ex games. From Souls games. Avalanche Just cause and mad max with Gearbox making Borderlands and whatever else they have cooking.

He would've been applauded for these acquisitions back in 2015. Half of us would be MS fanboys right now. But no, he had to have Minecraft.

that’s probably what their plan was from the start, remember how it came out they had offered Sony a 3 year deal after the current agreement Sony had with ABK ended? coincidentally that would have it end right around 2028 when Microsoft expects a new console generation to start…

by making it a 10 year deal Microsoft probably figured that just made them have to wait through one more console generation after this one and then post PS6/Xbox Unity they would take it exclusive

with all the revelations today about how Phil actually doesn’t like making games not exclusive, I have no doubt they never intend to keep things on PlayStation longer than they contractually are obligated to
