Let's think this through. Activision is under contract to sell itself to MS. On what planet are we to believe MS signed a contract with Activision, which would allow Activision to cut new deals with Sony while the deal is pending?

There would be no need to cut new deals if they were all-in on the buyout.
 
I don't think it's that. I think the era of buying a publisher is over for all these companies if this deal fails.
Im just wondering what that means when a publisher is legit in financial trouble and has to sell itself........they have to sell their IPs and studios in bits and peices? highest bidders win? we may still end up with a scenario of the biggest spenders getting it all (MS/Xbox)

You're crazy if you believe that anyone can stop an exclusivity deal between 2 separate companies. The CMA can't block a company for doing whats best for their shareholders it doesn't have that power.
I would have shared your sentiment but it seems the CMA can atleast butcher a deal to the point where a company potentially walk away from a deal the CMD done like. Maybe thats the plan? Something about all of it doesnt sit well with me, though. especially after reading some of their statements.

MS is probably gonna be happy to guarantee CoD's parity and availability on all platforms in perpetuity to butter the concessions forward to the EC/CMA.

Them having concerns about the deal and asking for remedies is something we all kinda knew was gonna happen months ago.

If splintering off CoD and keeping King (and Blizzard) is the only option on the table after the concession back and forth, they'll probably take it instead of dropping the whole deal.

They won't cost 70 freaking billion dollars if they were in legit trouble. People fail to see how unique of a situation this is, Activision is one of the biggest dogs in the gaming industry not just some random ass publisher.

As an Xbox gamer, MS buying ABK does nothing for me. It gives me no extra content, nor does it give Xbox more exclusive content. MS were banking on COD going into GP as a way to drive sales, but in the end they even offered COD to Sony to put into Plus.

I really don't care if the deal goes through.
I would much rather that MS buys Asobo, IO, Avalanche, Certain Affinity, Edios and CD instead of ABK

I would not be surprised if MS and Activision come to an agreement to sell King to MS instead of the whole lot.

I would also not be surprised if Sony losses out here as well. They can't expect to act like total cunts and fuck over both MS and Activision and expect no payback.
After the PS deal with COD ends, I would think the chances of Sony getting another deal to be zero.
We all know Bobby is a vindictive bastard, and Sony just fucked him out of 200 million dollars personally, so Microsoft will get the advertising rights and exclusive content not available on PS. On top of that, don't be surprised to see COD day 1 on GP.
Sony need to pay a price.

The problem with that kind of thinking is you are thinking with emotion. Bobby, his board of trustees and shareholders tend to think with their wallets. If Acti/Blizz deal is over, and Sony is the highest bidder, guess who will get the marketing deal?

If they were clear about Bethesda intentions before approval, this deal might have been approved with minimum behavioral remedies.

If they didn't announce a release date for Starfield that they could not meet, their intentions to make that exclusive might not even be known yet (and wouldn't be used against them).

If they didn't gas light everyone about mobile, then no-one would be able to say you can still achieve your primary goal without COD.
I genuinely don't know what's better… all of MSFT's lies catching up with them and biting them in the ass, or all the lies Xbox fans keep telling themselves while trying to hold back their tears.

So now the great hope is marketing rights if the deal goes to pot?

Wait until these guys see what Microsoft's assessment was on the impact of COD marketing rights.
