Which is precisely why the FTC has pursued their line of questioning today. They have proven that Spencer lied under oath before and willfully lied to regulators about Zenimax, proving the Judge cannot take their "promises under oath" at face value. They will do whatever they want.

Even 5 years from now they could replace Spencer with Bond and point to a "dynamic" market and argue they shouldn't be held in perpetuity for something said that long ago. They would absolutely try something like that. Knowing full well how resistant the US is to breaking up established companies.

other than the ESVI one, what other things do we have on him specifically lying under oath?

so, in the last year microsoft made all the necessary calculations regarding a exclusive cod on xbox, advantages and disadvantages, user shifts between ecosystems, they calculated how much it would take to make up for a drop in revenues on the competitor platform, how much it would raise their own subscription service and sales in their own ecosystem... but today they swear they would never make cod exclusive.

People have told me that Phil has told so many lies to FTC and EC during zenimax acquisition. They only one that I can call at least a lie is the one about ESVI, and that one you can still say it did not break the "case by case" claim.
 
If their model suggests they only need 2 million per year growth to offset making it exclusive then it will be exclusive as soon as any prior marketing deals expire or terminate.

How do you calculate the ease of achieving that?
PS5 COD players who are going to sign up for Gamepass? I doubt very much that PS5 users and rooted to the platforms will add. In any case it would only be between COD players. It also means that EVERY YEAR another 2 million should be registered..... I doubt very much that MS is interested in setting that challenge vs continue to release the game on PS5

Is this a serious statement? Of course they are going to want the number even if exclusivity is never the plan... big corps love their spreadsheets man. Nothing wrong with them going back and forth analyzing and weighing options.

He still lied. In court. Once or a hundred times. He lied. That makes him untrustworthy. But we already knew that about Phil. The judge should too, now.

Could be as there were two main groups in the main Discord (and Teamspeak prior to that) that I was a part of

The main group was open to the public but not overly well known and was moderated fairly heavily

The private group consisted of maybe 10 of us and was invite only and that was the open talk group and was the group that got the spicy info some of which has been coming up in these proceedings

Its a huge reason why I am not commenting much on this because have been several times that what some has said under oath that doesn't line up with what was said behind closed doors

Love watching the fanboys rip each other apart. Imagine sitting around in 2008 and someone tells you 15 years down the road COD potentially going exclusive would be a major controversy for regulatory agencies across the world.
 
I asked you to list the remasters/remakes made by Microsoft.

List them.

They shut down servers of games they didn't perform well, which happens all the time with developers.

Start naming those remasters\remakes

You can look up a list of remakes and BC games from MS yourself. It's quite an extensive list, with many boosts to frame rated and resolution.
 
And that debunks Amy Hood's claim that they never assessed COD's removal from PlayStation.

Edit: They are literally talking about this right now on the call. The Microsoft lawyer and Tim Stuart literally talking about this right now.

Was she part of the assessment? I am only loosely following this now while i eat haha

Not to "spin" this, but that's due diligence, is it not? A business would HAVE to look at all strategies to see what would be most profitable.

Not saying Microsoft should be trusted, as a lot of these emails have shown pretty damning things, but a business looking at all possibilities is not as damning as you think it is.

To answer the question: What would be the most profitable strategy moving forward with Activision, you would have to look at all possible strategies.
 
ah so they just made sure to not include her in hopes that her testimony would make it look like they hadn't done it at all

if anything this trial is just demonstrating how little Microsoft respects anyone, not just their own consumers but also the governments and et al.

the FTC has managed to shown now multiple times where Microsoft has either been incredibly weasely with how they word things or even just flat out lied

Yes, she gave her testimony and claimed that even the board did not do it. Today's email showed that the board asked for that assessment and was provided the data.

And her only real out for that is to say she wasn't aware. That would only help absolve HER. Other elements in the company, high up at that, ran such an assessment and seemed to have noted possibilities for it to make sense.

Apparently, if what I'm reading online is accurate, FTC chose not to ask Amy Hood to the stand, they should have since she's the higher authority.
