A Los Angeles judge refused Wednesday to reopen the case of France exile and filmmaker Roman Polanski, who pleaded guilty in 1977 to raping a 13-year-old but left the United States before sentencing.

Judge James Brandlin, from the superior court of Los Angeles, turned down a request from Polanski's lawyers, who wanted a new hearing to try and close the case on procedural grounds.

Brandlin said the request had no constitutional basis, and the Academy Award-winner had even less right to the procedural hearing than he did when he fled justice 37 years ago.

In a nine-page ruling, the judge also noted that the US had consistently asked for Polanski's extradition.

In 1977, the filmmaker, then aged 43, was accused of raping Samantha Geimer after a photo shoot.

He pleaded guilty to unlawful sex with a minor, or statutory rape, avoiding a trial, but then fled the country fearing a hefty sentence.


US officials have pressed for his extradition regularly to no avail.

Last October, US authorities unsuccessfully sought his arrest while he was in Poland.

In September 2009, Polanski, who became a French citizen in 1976 after moving there from Poland, was arrested in Switzerland on an international arrest warrant. After being held for months, Polanski was released.

Geimer wrote a book about her encounter with Polanski last year. Geimer wrote she was made to drink champagne and was given a sleeping pill before being raped by Polanski in the house of actor Jack Nicholson.

Polanski's work includes "Rosemary's Baby," "Chinatown," and "The Tenant".

This, regardless of the circumstances there is no way to justify what he did. If he had any shred of dignity he'd have already returned to the U.S. long ago to face justice. You don't get to just run away and then try to weasel your way out of it long after the fact.
 
I would give him a second chance if he actually owned up to what he did and face the penalties aka come back to the US. I don't care if it's been 100 years, this fucker deserves nothing.

While I sympathize with what he went through with the Sharon Tate murder, I'd like to think that in a similar situation most people wouldn't make themselves feel better by drugging and anally raping 13 year olds. Polanski may be a good film maker but he's a scummy human being.

How about we just stick to the facts and don't throw baseless accusations? It's OK to be mad at Polanski for what he did, but come on. That wasn't necessary.

There's a pretty major difference between accused of child molestation and actually admitting to doing it. It's why the legal system exists in the first place: to make those distinctions.

He never understood what the big deal was when he got in trouble for raping that girl. So yeah, no doubt he's still getting his Barney on with little girls.

It's a logical conclusion to draw, and he's never faced any real punishments for what he's done. Someone who is brazen enough to drug and rape a 13-year old is worthy of derision. He continued to live as a free man potentially harming other children.

I absolutely hate that such a despicable monster is capable of producing such great works of art. But what I hate even more is people defending him solely because of his work. Dude's made some of my favorite films of all time, but I would gladly trade all of the movies he made after fleeing the States if it meant he could have been locked up the whole time.

There's a fundamental principle in law: a state never extradites its own citizens. That would go against the protection it owes them. That said, it doesn't mean said citizens cant be prosecuted in their home country.
Why hasn't he been prosecuted in France then?

Roman Polanski is a citizen of France.

From what I understand France wont extradite their own citizens. IIRC it's an exemption France has with it's extradition treaty with the US.

For example the UK doesn't have that same policy for UK citizens.

Is he allowed in the UK by the way?

We have a extradition treaty with the usa that is pretty tight(and one sided but thats for another time). So not unless he wants to go to jail.

I don't know. Maybe there is no appopriate treaty between France and the USA, or maybe the USA haven't asked France to prosecute him because they're still expecting to judge him themselves? That would be my guess but honestly I don't have the answer.

Is he allowed in the UK by the way?

He's free to move anywhere in France, Switzerland and Poland.
