Pokemon Prism (Crystal ROM Hack in Development for 8 years) C&D'd by Nintendo

Lmao how many people are not getting sun and moon to just play this? Almost zero.

So if tomorrow one of the main activity of Nintendo is making tshirts, then the "fan made tshirts" would be most likely removed of the market, right?

What I feel a little unfair is that those guys who make fan games are not making money from it, or at least not directly, so it's a bit exagerated to kill those projects. It's not like it would kill, for exemple, the Pokémon Sun & Moon sales anyway. That's my opinion at least.

One could argue even if only one sale was loss then the existence of the fan games was detrimental to the franchise. Yeah thats a comically extreme viewpoint and wouldn't even be a statical blimp on the bottom line. As long as the answer to "sales lost because of a fan game" is potentially not zero which nobody can prove then it can be rationalized by those in power that c&d is always the right decision.

Nintendo is a hardware and software manufacturer and until this year you had to own a Nintendo system to legally play any of their games. A ROM hack requires the ROM. So no, this wasn't given a C&D because you can "now" play a Pokemon game on the PC. You can still play Pokemon Crystal on your PC if you have the ROM. You just can't play Pokemon Prism.

They literally distributing a ROM. You can mod anything in your house, like you want. But if you distributing to other people, you break copyright laws.

What makes this story significant is that they were not doing that. It's akin to Nintendo going after people who make (not even sell) console decals.

Are they? Every romhack I've encountered is distributed through an IPS/Patch file. It's up to you to download the rom and patch it.
 
It was never planned to have a distributed ROM, only a patch. There was even a custom patch format developed to prevent anyone from acquiring anything related to it without verifying and patching an existing ROM - a ROM that nobody would release or distribute.

This is a very tough situation, one with no good answer.

At this time, no person on the development team is, or will be releasing the game. We have all abided and will continue to do so.

It really, really... really sucks.

so fucking upset about this... I played one of the first betas of this game ever way back in the day and adored everything about it. It was set to be the greatest GBC Pokemon hack ever imo.

KBM must be absolutely fucking crushed. </3 :(

This sets a dangerous precedent in terms of Nintendo ROM hacking as well... which is fucking terrible because there are some absolutely phenomenal ROM hacks of many games available that I've played over the years.
 
Man I hate this, Pokemon rom hacks are really fun games to tide over between releases or give a slightly different taste of pokemon compared to what you usually get. I personally like the ones that slightly change things, but keep the base game, like swap pokemon found and what not. But eh... I guess Nintendo is getting more and more serious about keeping their IP under lock and key.

Do ROM hacks differ, from a legal standpoint, from cheat codes?

Nintendo went after GameGenie way back and lost because the judge determined that it was not a derivative work(because it could not exist separate from Nintendo's console/games) and that it fell under fair use because consumers should be allowed to do whatever they please with their own hardware/software.

On those two points I'd say the "derivative work" point is the hardest to deny in this case, but by the same reasoning as cheating, ROM hacks do not function apart from the original game.

Even if you aren't making money, you are getting lots of press due to using a known IP rather than your own, which might translate to making money from it in more indirect ways (donations, patreon support, job offers, whatever).

If you're willing to spend years working on a game that will be using an IP you don't even own, then your best bet is to do a stealth release so that it actually manages to get out there rather than publishing trailers and such. The game might avoid detection at first, but the chances of that happening go lower and lower as you call more attention to it.

Announcing your 3D Chrono Trigger remake, Sonic game made in Unity and even ROM hacks before getting the actual release out there means you might lose your chance to have the project actually see the light of day, which isn't a good idea since that risk far outweights the gains you could get from promoting the game prior to launch.

I know very little of this only that they let the TPP channel stream a version but I don't know if that version was final/the one they will release or if it was one with some bugs/unfinished.

Reading through the 4chan thread, it seems to be the latter. So there'd be some left out content, a few areas not fully fleshed-out (KBM commented on this being something he wanted to fix during the TPP stream), and a handful of bugs. I think they ironed out most of the major gamebreaking stuff during the stream session so there shouldn't be anything too bad.

meanwhile sega has a developer who previously made a bunch of sonic fan games heading one of their next mainline sonic games, and it looks genuinely great. shows how backwards nintendo have it in comparison; this sort of disdain for hardworking, talented and passionate fans just wanting to share a fan mod they've worked on for years with other fans of the series is super shitty and counter productive.


i think the poster was implying they were looking forward to the game, not that they were looking forward for it to be shut down.

Consumers getting confused and angry at Nintendo could happen, and getting one phonecall wasting time or one lost sale because you can play a free Pokemon game hurts Nintendo. Theyre protecting their property. I dont understand attacking Lets Plays on Youtube but this i get.

I know its not easy creating your own world but if they did they could monetize it at least. Nintendo has made their stance clear. Theyre protecting their bottom-line, and in this instance makes it complete sense.

Yeah, I really hadn't heard of it until this C&D but now that I've got a chance to test it out, I didn't realize how much I wanted a retro styled Pokemon game with up to date mechanics. It's a lot of fun.

I'm sure it's been said; but if you're going to straight up lift a corporation's IP to make a game, do it quietly. Make it silently, release it and THEN wait for the C&D. Everyone who is surprised or hurt by Nintendo asking for this to stop, I mean, c'mon. What do you expect.

If they used Nintendo's assets than I don't blame Nintendo for stopping them. There's a murky line between fan adoration and leeching and I can't really fault Nintendo for being aggressive about this. It's something I worry about (and have friends who have had experiences dealing with this sort of thing). I always err to the side of the original creators though so I'm biased
